Referral of Retail Tenancy Dispute

This form may be used to refer a retail tenancy dispute to the Small Business Commissioner. A retail tenancy dispute is a dispute between a landlord and a tenant arising under or in relation to a lease of a retail premises. Information relating to the dispute resolution and mediation process and the definition of a retail premises dispute can be found under the Retail Tenancy Matters section of the Website.

This referral form should be used only in cases where the applicant is prepared to undertake mediation with the Office of the Small Business Commissioner. If a party will not mediate or if the dispute is not resolved at mediation, the Small Business Commissioner can issue a certificate to enable proceedings to commence at VCAT.

Submission of this on-line referral will generate an identification number for you to use. You will have the ability to print this identifier together with a copy of your referral.

Before submitting the information you have entered you will have an opportunity to review it, and make amendments if necessary. Note that, for technical reasons, the form must be submitted within 30 minutes of being opened.
